2. Processing of Personal Data

Personal data is information that can identify a natural person. This includes, for example, name, email address, address, and IP address.

We only collect and use your personal data in accordance with the provisions of the regulations on data protection law of the European Union and the Federal Republic of Germany. In the following, we inform you about the type, purpose, and scope of the collection and use of your personal data. Your data will not be processed beyond this.

The website collects a series of general data and information with each visit by a data subject or an automated system. This general data and information is stored in the server's log files.

Therefore, the data and information collected anonymously will be used for statistical purposes as well as with the aim of increasing the data protection and data security of our enterprise so that we can ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from any personal data provided by a data subject.

We process personal data that you provide when you place an order through our web shop, create a customer account, enter one of our competitions and contests, contact us, and offer a manuscript or portfolio.

We do not intend to solicit or collect personal information from anyone under the age of 16. If you are under the age of 16, please do not enter any information on this website or use our services. If you believe that any of your children under the age of 16 have submitted personal information, please contact us at datenschutz@magellanverlag.de to have the data removed and, if necessary, to cancel the order that has been placed.

2.2.1 Cookies

In order to offer you the best possible user experience on our website, we use so-called cookies on various pages. These are small text files that are stored on your terminal device to save specific information related to the device. On the one hand, these cookies help to make the website more user-friendly and, on the other hand, they collect statistical data on usage to enable us to analyse this in regard to improving the website. The legal basis for the data processing associated with this is Article 6 para. (1) f) and Article 6 para. 1 a) GDPR in conjunction with your consent.

In order to design our website in the best possible way, we use so-called tracking tools to measure user behaviour on our website and improve our offer accordingly. The data includes, for example, the sequence of page views, the time spent on the individual pages, as well as the search and click behaviour. We evaluate this information statistically to find out which parts of our website are particularly attractive, and which pages we can improve for the user experience. For this purpose, we mainly use the automatically collected data mentioned in 2.1.1 Cookies.

The legal basis for this data processing is Article 6 para. 1 f) GDPR, a balancing of interests based on our interest in adapting and optimising the website to the interests and needs of users.

2.2.4 Direct Marketing

If you give us your consent to receive direct marketing (for example catalogues, mailings), for example in the form of emails or registration forms, independently of a contract or account on our website, we will only use your data to carry out the corresponding direct marketing measures.

The legal basis for this is your consent in accordance with Article 6 para. 1 a) GDPR. 2.2.5 Direct Marketing to Business Contacts and Interest Groups

We email information about our titles to groups of people who are potentially interested for professional reasons, such as business contacts, journalists, bloggers, and influencers. The legal basis for this data processing is Article 6 para. 1 f) GDPR, our legitimate interest in offering our creatives and their works the greatest possible publicity and thus contributing to cultural diversity.

2.2.6 Contacting

If you contact us via our contact form or by email, we will store the data you provide in order to process your request. The legal basis is Article 6 para. 1 f) GDPR, our legitimate interest in processing enquiries from users of our website or interested parties.

2.3 Disclosure of Data

If you order via our web shop, your order data will be passed on to our parent company BVG Bamberger VerlagsGruppe GmbH & Co. KG for order processing.

Your data will also be transferred to the postal service for order processing. In addition, data is forwarded to the corresponding payment service during payment. We are also obliged by various legal regulations to pass on the data to the tax office or other authorities, if necessary.

2.4 Data Processor

We have commissioned external service providers for the operation of our website and the associated data processing, for example in the areas of administration and marketing. With these service providers, we concluded data processing agreements to ensure the protection of your data.

2.5 Deletion of Data

Google Analytics uses cookies. The information generated by the cookies about your use of this website is usually transferred to a Google server and stored there. On our website, IP anonymisation by an extension of the code is activated. Therefore, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. In cases where personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield (https://www.privacyshield.gov/list) and guarantees an adequate level of data protection on this basis. The data sent and linked to cookies, user identification (for example, user ID), or advertising IDs are automatically deleted after 26 months. The deletion of data which has reached the end of its retention period takes place automatically once a month.

On behalf of the site operator, Google will use the collected information to evaluate the use of the website, to compile reports on website activity, and to provide the site operator with other services relating to website activity and internet usage. The IP address transmitted by the corresponding browser within the scope of Google Analytics is not merged with other Google data.

3.4 PayPal-PLUS

In our shop, we use the provider PayPal (PayPal (Europe) S.à.r.l.) & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg) to process payment transactions via PayPal, credit card, and direct debit. If you decide to use one of these payment methods, your data will be transmitted to PayPal during the payment process in the order process. PayPal takes over the function of an online payment service provider as well as a trustee and offers buyer protection services.

4.1 Facebook and Instagram

When you visit our Facebook or Instagram fan page, we receive anonymised visitor statistics (insights) that provide information about how users interact with our site. We do not receive data that allows conclusions to be drawn about individual people.

As operators of the fan pages, we are responsible for the visitor statistics (Insights) together with Facebook (Facebook Inc., headquarters: 1 Hacker Way, 94025 Menlo Park, CA, USA; for users within the EU: Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) under Article 26 GDPR, with Facebook taking primary responsibility. According to Article 6 para. 1 f) GDPR, the legal basis for the use of Insights data is our legitimate interest in providing information and communication offers for interested parties and customers via social networks and optimising these.

When you visit our Facebook or Instagram fan page, Facebook places cookies on your device for the purpose of storing information in the browser and recording and processing information. They remain effective for a period of up to two years unless you delete them. Cookies are stored when you access our pages regardless of whether you have a Facebook or Instagram account. If you have an account, Facebook collects data when you visit our pages, if you have provided it in your account, and processes it. This includes age, gender, relationship status, professional situation as well as information about your lifestyle, your interests and your purchases or purchasing behaviour (demographic data), and your location (geographical data). The processing is used by Facebook to personalise its information services and advertising. If you do not have an account, your IP address, information about your device, region, or, if applicable, location, call time, and dwell time are collected, and the demographic information mentioned above is estimated based on your browsing behaviour.

4.2 YouTube

We integrate videos on our website via the YouTube platform (YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA).

Integration only takes place in the extended data protection mode. This is provided by YouTube itself and ensures that YouTube does not initially store any cookies on your device. When you click to play a video, YouTube only stores cookies that do not contain personally identifiable information unless you are logged into your YouTube account. If you are logged in to your account, this user data will be assigned to your account. You can prevent this by logging out of your account before accessing a video on our website.

5. Data Subject Rights

In addition, in accordance with the German Data Protection Act (BDSG) and GDPR, you have the right to obtain information free of charge at any time about the personal data stored and passed on by Magellan GmbH & Co.
